Current Contract/Terms and Conditions for Coleman Custom Builders LLC

BID WORK: We work off of a payment plan of 50/25/25. 50% due at signing before starting the job so materials can be ordered. 25% due at the 3/4 finished mark of the job, and the remaining 25% is due on the day of completion. Last payment must be made on or before Coleman Builders has left the job site on the last day of work. If the job is canceled by the business or homeowner before the work is started there will be a 10% non-refundable charge taken from the 50% down to cover administrative costs.


TIME & MATERIAL JOBS: Time and Material work is billed out between Friday & Sunday for the preceding week. 5% of estimated cost due upon signing for upfront material costs. This amount is due before you will be placed on the schedule. All materials and man hours will be billed out in full. Man hours are as follows – $90-$150/HR for each employee on site (subject to change dependent on scope of work, please see above for your rate). Time will include accrued time on jobsite, time to collect and return materials, subcontracting arrangements, plan design/engineering consultations, etc… There will be no up charge for materials although if we pick up or return materials on your behalf you will be charged for the man hours to do so. ***

Please note that there will be NO charge for the estimate and any time accrued prior to the contract being signed if you decide to work with Coleman Builders. If you choose not to work with us after the estimate is provided you will be billed for the time spent to complete the estimate and any other costs accrued after this contract is signed.

The Contractor shall defend, indemnify and hold Coleman Custom Builders LLC its officers, agents, volunteers, owners & employees harmless from any and all claims, injuries, damages, losses or suits including attorney fees, arising out of or in connection with the performance of this Agreement, except for injuries and damages caused by the sole negligence of the Owner.

In the event of liability for damages arising out of bodily injury to persons or damages to property caused by or resulting from the concurrent negligence of Coleman Custom Builders LLC the owners, officers, agents, county/city officers, subcontractors, volunteers or employees, the Contractor’s liability hereunder shall be only to the extent of the Contractor’s negligence.

In the event that Party 1 or Party 2 is required to incur legal fees or costs for the collection of money or services due and owing under this Agreement, the prevailing party will be entitled to attorney fees and collection costs, whether or not a suit or action is filed. If a suit or action is filed, either party may recover both attorney fees at trial and on appeal.

Payment is due immediately upon receipt although we do allow a 5 day grace period to receive payment. After 60 days of NON payment an interest charge will be included for the entire balance due on the account at 1.5% per month as allowed by Oregon law. https://oregon.public.law/statutes/ors_279c.570

All start dates are ESTIMATES and are subject to change.

If there are any unforeseen problems that may be uncovered during the construction process there may be a charge order issued to address compensation.

All work completed by Coleman Builders carries a one year Warranty against workmanship.
